You Must Be 21 Years Of Age Or Older To Rent A Property.
Certain Properties Require A Minimum Age of 25 Years or
Older.
The guest named on the rental agreement
must be present at check-in and present at the property rented, a photo ID will
be required upon arrival. The use of
your rental property(s) shall not be such as to disturb or offend any
neighboring properties tenants. Heavenly
Mountain Vacations, LLC (Agent) reserves the right to terminate this agreement
and ask guests to vacate the premises with no refund of any monies if this
policy is violated. Agent reserves the
right to refuse rental to any group.
Check In /Check
Out: Check in is at 4:00pm; however this is not a
guarantee. Occasionally, due to unavoidable circumstances, a property may not
be ready for Check-In at 4:00pm. Please do not expect an early check-in,
however if you would like to come to our office and complete your paperwork and
payment we can contact you as soon as your property is available. No Check-In
will be permitted until your rental account has been paid in full, including
taxes and any other fees. Final payment
may be made by Cash, Credit or Debit Card (We accept Visa and Master Card),
Money Order or Cashier’s Check. Our office hours are Monday through Sunday from
9:00am to 6:00pm. If you will be
arriving later than our office hours, please call 1-866-997-6659 to make
arrangements for a late arrival package.
We ask that you return to the office the following day by 12:00am to complete
your paperwork. Guests who have a late arrival package and do not complete
Check-In paperwork by 2:00pm the following day will be assessed a $50.00 late
processing fee. Please Note: In observation of two national holidays, no
reservations will be scheduled for arrival on Thanksgiving Day and Christmas
Day. Check out is 11:00am. A late checkout fee of $50.00 may be assessed
if Check-Out time is exceeded. Check-Out Procedures: Heavenly Mountain Vacations LLC requests that
Guests place used dishes in the dishwasher, set the thermostat at 60 degrees in
the winter and 77 degrees in the summer; turn off all electrical items
including lights and fans; secure the hot tub cover(s); secure all doors and
windows and place all trash in outdoor receptacles. The need for excessive
cleaning, or excessive trash may incur and additional charge.
Excessive
Cleaning and Damages: At the time of arrival a
security deposit will be placed on the credit card of the guest named on the
rental agreement. The deposit schedule is:
(1 bedroom: $200.00, 2 bedrooms: $300.00, 3 bedrooms: $400.00, 4 bedrooms:
$500.00, 6 bedrooms: $700.00, 7 bedrooms: $800.00, 8-12 bedrooms: $1000.00). This
is simply a hold on your credit card and will not show on your credit card
statement as a charge. In the event of
damages, missing items, the need for excessive cleaning, and/or reimbursement
to neighboring cabins, this security deposit will be used. Charges could exceed the security deposit. Security deposit(s) will be released within
14 business days pending verification of rental property(s). Damaged and/or missing linen will result in a
minimum charge of $50.00.
Reservation
Requirements: Reservations are not
considered guaranteed until a signed rental lease agreement and the deposit
payments are satisfied. We accept Visa,
Master Card, and Discover, Cashier’s Check or Money Order. We accept personal and business checks for
the initial deposit only. However,
personal and business checks must be received no later than 10 business days
after the time of booking, but not less than 30 days prior to Check-In. Final
payment may be made by Credit or Debit card, Money Order or Cashier’s check. We
cannot accept personal or business checks upon Check-In. Returned Checks will
result in a $40.00 returned check fee. Pursuant to the provisions of the
Tennessee Code Annotated, Title 47, Chapter 18and Title 62, Chapter 13, Section
62-13-104(b)(3), Subdivision (D)(i), Heavenly Mountain Vacations, LLC discloses
the following policy as of March 22, 2009: “All advance rent deposits, damage
deposits and balance of rent due are deposited into a bank escrow clearing
account. These deposits are considered income to heavenly Mountain Vacations,
LLC upon receipt and may be used immediately. Any refund considerations are
expensed from the general books of Heavenly Mountain vacations, LLC on a case
by case basis.”
Confirmation of
Reservation: Confirmation of the
reservation(s) will be e-mailed, faxed, or mailed to Guest(s) upon receipt of
the reservation deposit. Guests may also print confirmation from the agent’s
website, sign and e-mail, fax or mail back to Heavenly Mountain Vacations. Please read the confirmation for accuracy of
dates, mailing address, number of guests and accommodations. Any errors should be immediately directed to
Heavenly Mountain Vacations office at 1-866-997-6659.
Cancellations
and Refunds: Our reservation policies
require half of the total cost of the reservation for a deposit. Cancellations may be made only by the person
listed on the reservation. Heavenly
Mountain Vacations is pleased to offer a 30 day cancellation with full refund (minus
reservation fee, cleaning fee and taxes) for all reservations in 1 through 3
bedroom cabins. Cancellations made
within 30 days of the arrival date will result in complete forfeiture of the
deposit and fees. Reservations on 4-12 bedroom cabins are afforded a 60 day
cancellation with full refund (minus reservation fee, cleaning fee and
tax). Cancellations made within 60 days
of the arrival date will result in a complete forfeiture of the deposit on
file. Cancellations are only confirmed
with an email receipt issued at the time of cancellation. Heavenly Mountain
Vacations performs regular maintenance on all properties and make every to keep
the amenities in working order. Agent
cannot guarantee against mechanical failure of heating, air conditioning, hot tubs,
TV’s, satellite, satellite receivers, DVD’s, games or other appliances. Please report any inoperative equipment to
our office immediately. Agent will make
every reasonable effort to have repairs done quickly and efficiently. No refunds will be made due to failure of
appliances or equipment. Agent is not responsible for damage to items from
amenities malfunction.
Early
departures: (less days than reserved), delayed arrivals, or reduction of the
number of nights reserved will not result in refunds of any monies received by
Agent. Neither Owner nor Agent shall be liable for events beyond their control
which may interfere with Guest(s) occupancy, including but not limited to Acts
of God, acts of governmental agencies, fire, strikes, war or inclement weather.
No refund will be given in the aforementioned events.
Reservation Changes:
Only the person named on the reservation may make changes to the
reservation. Changes my only be made by calling Heavenly Mountain Vacations’
office and may be made only 30 days prior to your arrival date for 1 through 3
bedroom properties and 60 days prior to your arrival date for 4 bedroom and
larger properties. Any change made to the reservation after the reservation has
been made will result in a 35.00 change fee.
Maximum
Occupancy: At all times, the maximum
occupancy is the number the home sleeps, including children. Occupancy limits are in accordance with rules
of the State Fire Marshalls Office.
Sleeping limits show as (for example) “sleeps 12”. Guests and visitors must be pre-approved by
Agent in advance. For approved
additional guests (over 10 years of age), you will be charged $15.00 per night
per guest. There is no charge for
children 10 years of age or younger. If
you bring additional guests or visitors without prior approval and payment,
guests will be asked to vacate the property and additional fees will be
assessed. Any security payments and all
monies paid will be subject to forfeiture.
No House Parties Are Allowed.
Pets and
Smoking: Our properties to not allow smoking or pets
unless specifically noted. If a cabin
allows pets, only mature dogs are permitted.
A maximum of 2 dogs per property is allowed. An $80.00 non –refundable pet fee WILL be
APPLIED per pet. Pets must be crated
when guests are not present on the property.
Any unauthorized pets or smoking in property(s) will be subject to a
minimum of $300.00 cleaning fee. Smoking
is allowable outside of the properties.
Guest
Responsibilities: All properties are
individually owned and are inspected upon check out by a member of our
staff. GUESTS ARE REQUIRED TO INFORM
HEAVENLY MOUNTAIN VACATIONS IF ANY BREAKAGE OR DAMAGE OCCURS DURING YOUR STAY
OR ARE OBSERVED UPON CHECK IN. Guest(s)
shall not destroy, deface, damage or remove any part of the property, renders
smoke detectors inoperable or rearranges any electronic wiring or plugs. If
wiring to any appliance has been tampered with or moved, charges will
result. Remote controls are programmed
to operate specific televisions, DVD players, theater systems, or ceiling fans. Reprogramming a remote or a service call for
reprogramming a remote will have a minimum charge of 25.00 per incident. Furnishings are subject to change without
notice. Furniture, linens, bedding,
mattress pads, utensils or any other property supplied with the rental property
must not be taken out or transferred from one property to another. Guests will be liable for any damages,
missing items or corrections that must be made.
Minimum Stays:
Some seasons will have minimum night requirements depending on
availability. Exceptions can be made if available
nights between the prior and later reservations make the required minimum not
possible.
What Is
Provided For You: Heavenly Mountain Vacations
provides a starter set of basic items you will need: laundry soap, dish detergents, paper towels, trash
bags, bath soap, shampoo, and toilet paper.
We suggest you bring additional supplies of these items. The linens provided are sufficient for the
amount of guests that the cabin sleeps.
Fireplaces/Outdoor
Fire Pits/Firewood: Gas and Fireplaces are seasonal
and will not be functional from May 15th through September 1st. If the property has a wood burning fireplace
or fire pit, firewood is not provided unless noted in the property amenities. Firewood can be obtained from local stores at
a reasonable cost.
Hot Tubs and
Hot Tub Covers: Hot tubs are cleaned can
chemically sanitized prior to each guest arrival. A bromine floater will be present in the hot
tub, please leave the bromine floater in the hot tub at all times. Because hot tubs are drained and refilled,
the water may not be warm until the evening of your arrival. Health risks are associated with the use of
hot tubs; they are to be used at your own discretion and with your sole
responsibility. Please shower before and after using the hot tub. Chemicals are used in the hot tub. Hot tub covers are fragile, when not in use
place the cover on the hot tub and secure it.
Damages to hot tub covers will be the responsibility of the
guest(s). I understand Heavenly Mountain
Vacations assumes no responsibility for any occurrence associated hot tub or
Jacuzzi usage.

Swimming Pools
and Resort Amenities: Some resort communities offer
swimming pool and amenities access, these amenities are open and available at
the resort’s discretion. Generally the
operational dates are late April to early October. Agent assumes no responsibility for any
occurrence associated with swimming pool or amenities use.
Pest Control:
Many different insects live in and thrive in The Great Smoky Mountains.
Every effort is made by Heavenly Mountain Vacations to control and minimize
this issue. Lady Bugs are a protected insect species and we are unable to
prevent their visits. Should you
experience a pest control issue, please contact our office so we can determine
your needs.
Guest(s)
Liability: I agree to indemnify and hold harmless the Owner and Agent for any
liabilities, theft, damage, cost or expense whatsoever arising from or related
to any claim or litigation which may arise out of or in connection with
Guest(s) use and occupancy of the rental property including but not limited to
any claim or liability for personal injury, damage or theft of property which
is made, incurred or sustained by Guest(s).
Each Guest is responsible for making sure they have all their belongings
when checking out. Owner and Agent will
not be responsible for items left behind.
If items are found in a property after a guest has left (at conclusion
of agreed rental period) Heavenly Mountain Vacations will hold found items for
a period of 60 days. It is the guest(s)
responsibility to contact a third party for shipment of the item(s) at the
guest(s) cost.
